Making a Murderer subject Steven Avery's first big move after finding new legal representation has been to file an appeal. In the new documents filed by Avery he says his former legal team's incompetence was responsible for his murder conviction in the 2005 Teresa Halbach case. Avery is asking a mistrial to be declared for reasons including the fact a juror influenced others into finding him guilty.

According to the documents, obtained by TMZ, the juror repeatedly said Avery was guilty and told jurors, "If you can't handle it why don't you tell them [the judge] and just leave." According to People the juror in question is identified as "C.W." in the documents meaning it could be none other than Carl Wardman. Wardman was just revealed as not only being a volunteer at the Manitowoc County Sheriff's Department at the time of Avery's trial but also as having a son who worked for the department.

Avery also states in the documents that Halbach’s vehicle wasn't sealed correctly allowing police to tamper with evidence and set him up by "planting his blood." He also says police violated the limits of the search warrant. Avery's appeal echoes one juror's claims that Avery was framed for Halbach's murder.
