Walmart Driver in Fatal Tracy Morgan Accident Doesn't Think He'll Get A Fair Trial

Remember the Walmart driver who tweeted “move or get hit” before he slammed into Tracy Morgan’s limo, seriously injuring the comedian and killing his mentor, James McNair? Well, he’s asking courts to drop the case because he doesn’t believe that he will receive a fair trial.

In legal documents, as reported by TMZ, Kevin Roper claims that Walmart, the National Transportation Safety Board (NTSB), Morgan's lawyers, and the media have already convicted him in the eyes of the public — making it impossible for him to receive a fair and unbiased trial. He also concedes that others have admitted their wrongdoing in the June 2014 accident including Walmart, who issued a press release taking responsibility for what happened.

Roper was on the road for more than 24 hours before striking Morgan's vehicle, putting the actor in a coma for two weeks and causing major brain trauma. Morgan recently settled with Walmart for an undisclosed amount. Roper is charged with death by auto and assault by auto.
