Of Course NYC Is Appealing Last Week's Soda Ban Ruling

It ain't over 'till it's over.

Last week, an appellate court ruled that the proposed ban on drinks exceeding 16 ounces at restaurants and movie theaters was unconstiutional. We promised that Mayor Michael Bloomberg would clap back with an appeal, and here it is, right on schedule. 

The New York City Law Department has requested that the New York State Court of Appeals give the case a once-over, claiming that the Department of Health has permission to resort to drastic measures in order to do what is best for public health in New York. Apparently, it's all about the greater good. Here's what the Law Department had to say, courtesy of Gothamist:

"This is a pressing public health matter that deserves careful review by the state’s highest court,” said New York City Corporation Counsel Michael A. Cardozo in a statement. “The Board of Health must be able to combat the growing obesity epidemic, and there is clear precedent for the board to have that authority.”
