The New York City soda ban—the one that everyone's up in arms about—has been given the Mutombo Finger Wag by a state judge. The ban, which is the brainchild of the Bloomberg administration, would've banned businesses in the city from selling large, sugary drinks. It would've gone into affect tomorrow.

Today, New York Supreme Court Judge Milton Tingling ruled that New York City is "enjoined and permanently restrained from implementing or enforcing the new regulations." He added that the rules are "fraught with arbitrary and capricious consequences."

This came almost at the last minute, and now health inspectors won't need to carry 17-ounce measuring cups to establishments to make sure that they fall in line with the rule. So go ahead and enjoy your big sodas, New York City. They appear to be here to stay.
