The ongoing legal battle between Dr. Luke and Kesha took a turn Tuesday when the producer reportedly filed a request to see Kesha's medical records.
Dr. Luke's legal team filed the papers in a Manhattan court, according to Page Six. In the documents, Dr. Luke claimed Kesha waived her right to therapist-patient confidentiality when she attempted to break her contract with Sony Music Group by citing "physical, emotional and sexual trauma inflicted by Mr. Gottwald."
Kesha's legal team reportedly countered his request, stating that such medical confidentiality protects "a person’s innermost thoughts and feelings." Kesha also insisted that sharing such documents with her alleged abuser could pave the way for other rape victims to diclose their therapy records.
Typically, HIPPA-covered medical officials can only share confidential records under a court order. A Manhattan judge will rule on the matter.
In April, Supreme Court Justice Shirley Werner Kornreich denied Kesha's appeal to be released from her recording contract and ruled against all but one of the singer's counterclaims. Kornreich cited several reasons for her decision, including the expired statute of limitations regarding Kesha's allegations, and the problem that Kesha couldn't prove any crime against her had occurred in New York.
Later that month, Kesha's mother Rosemary "Pebe" Sebert dropped her own lawsuit against Dr. Luke. Since April, Kesha has been busy recording music with Zedd. She will also appear this weekend at the Billboard Music Awards for a performance, though it's unclear what exactly she has planned.
Dr. Luke's legal team did not immediately respond to Complex's request for comment.
